DMCA & Intellectual Property Policy

Our procedures for handling copyright infringement claims and intellectual property protection.

1. DMCA Safe Harbor

Aneutral LLC operates as a service provider under the Digital Millennium Copyright Act (DMCA). We comply with 17 U.S.C. § 512 and respond promptly to valid notices of alleged copyright infringement.

3. Filing a DMCA Takedown Notice

To file a valid DMCA takedown notice under 17 U.S.C. § 512(c)(3), your notice must include the following six elements:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material that is claimed to be infringing, with information reasonably sufficient to permit us to locate the material (e.g., URL, username, or description of the content).
  4. Your contact information, including address, telephone number, and email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of the copyright that is allegedly infringed.

Warning: Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorneys' fees.

4. Processing Takedown Notices

Upon receiving a valid DMCA takedown notice, we will promptly:

  • Remove or disable access to the allegedly infringing material.
  • Notify the user who posted the material that it has been removed.
  • Inform the user of their right to file a counter-notification.

5. Filing a Counter-Notification

If you believe your content was removed in error or is not infringing, you may file a counter-notification. Your counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the location where it appeared before removal.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if outside the United States, any judicial district in which Aneutral may be found, and that you will accept service of process from the person who provided the original takedown notice.

6. Processing Counter-Notifications

Upon receiving a valid counter-notification, we will forward it to the original complainant and inform them that the removed material will be restored in 10 business days unless we receive notice that the complainant has filed a court action seeking to restrain the user from engaging in the infringing activity.

7. Repeat Infringer Policy

Aneutral maintains a repeat infringer policy in accordance with the DMCA:

  • First offense: Warning issued and infringing content removed.
  • Second offense: Permanent account termination.

An offense is considered "uncontested" when no valid counter-notification has been filed or a court has made a determination of infringement. We reserve the right to terminate an account after a single offense in egregious cases.

8. User Content License

By uploading or submitting content to Aneutral, you grant Aneutral LLC a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use your content for the purpose of operating, providing, improving, and promoting the Service.

This license includes the right to display, distribute, and modify your content for technical purposes (including resizing, compressing, and format conversion), and to moderate content in accordance with our Community Guidelines.

This license does not transfer ownership of your content. The license terminates when you delete the content or your account, except with respect to content that has been shared with other users, incorporated into backups that are subsequently overwritten, or that we are required to retain for legal compliance.

9. Aneutral Intellectual Property

All intellectual property associated with the Service is owned by Aneutral LLC. This includes:

  • The Aneutral name, logo, and branding
  • The design, user interface, and user experience of the Service
  • Source code, algorithms, and documentation
  • Marketing materials and content

These materials are protected by copyright, trademark, patent, and trade secret law. No rights are transferred to you by your use of the Service. You may not:

  • Copy, reproduce, or distribute any part of the Service
  • Use the Aneutral name or logo without prior written permission
  • Reverse-engineer, decompile, or disassemble the Service
  • Create derivative works based on the Service

10. Trademark Guidance

"Aneutral" and the Aneutral logo are trademarks of Aneutral LLC. When referencing our trademarks:

  • Use "Aneutral" as a proper noun.
  • Do not alter the spelling or presentation of our marks.
  • Do not imply endorsement or affiliation without authorization.
  • Do not use our marks in a disparaging or misleading context.
